Inheritance Claims

Inheritance Claims

Provided you fall within the class of potential claimants (including being a wife or a husband a defacto partner a child or grandchild)* and in the event you believe your share left to you in a Will is not adequate or if you have been left out of a Will altogether you may have grounds to contest the Will and make an Inheritance Claim against the Estate.

Inheritance Claims are made pursuant to the provisions of the Inhertiance Family Provision Act. A time limit to make a claim of 6 months after the Grant of Probate applies. You must obtain advice as soon as possible after the date of death of the deceased.

Negotiation and Mediation are methods of avoiding costly litigation and in appropriate cases we employ those methods with the aim of resolving disputes promptly. If Court action is necessary or if a claim needs to be defended Stokes Legal are able to pursue claims or defend actions involving Inheritance disputes.
